NovaPanel End User License Agreement

Version 1.0 · Published by 1onHost · https://1onhost.com/legal/novapanel-eula

Template notice for the owner (remove before relying on it): this agreement is a plain-English template. Have a lawyer qualified in your jurisdiction review it, and replace [COUNTRY] (and any other bracketed text) before you rely on it.

This End User License Agreement ("Agreement") is between you (the person or organisation installing or using NovaPanel, "you") and 1onHost ("1onHost", "we", "us"), the vendor of NovaPanel (1onHost is operated by 1onhost). It covers the NovaPanel hosting control panel, its installer and updater, its add-ons, the malware signatures and other data we deliver to it, its documentation, and every update we provide (together, the "Software").

By typing "yes" in the installer, installing with --accept-eula, clicking "I accept the EULA" in the panel, ticking "I accept the NovaPanel EULA" when you order, or otherwise installing or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software. If you accept on behalf of an organisation, you confirm that you may bind it.

1. The licence we give you

  1. One licence per server. Each NovaPanel licence you buy from 1onHost lets you install and run one copy of the Software on one server, identified by the IP address (or addresses) registered to that licence. Running NovaPanel on another server needs another licence, or moving the licence to that server in the 1onHost client area (the first server then stops being licensed).
  2. Add-ons. Paid add-ons (for example the Malware Scanner) may only be used while they are part of an active licence for that server.
  3. Term. The licence lasts for the period you paid for and renews while you keep paying. It is non-exclusive and non-transferable, except that you may move it between your own servers as described above.
  4. Hosting your customers. You may use the Software to host websites, e-mail and other services for yourself and for your own customers. Your customers may use the user panel, but they receive no licence to the Software itself.
  5. Ownership. The Software is licensed, not sold. 1onHost and its licensors keep all rights, title and intellectual property in the Software. Everything not expressly granted here is reserved.

2. What you must not do

You must not, and must not help or allow anyone else to:

  1. Redistribute or share packages. Copy, sell, rent, lend, sublicense, publish, upload or give the Software, its installation packages or its update packages to anyone else, or install them on a server that is not covered by a licence. Packages downloaded with your licence are for the licensed server only.
  2. Reverse engineer. Decompile, disassemble, decrypt or otherwise try to obtain the source code of the Software, or create derivative works from it, except where the law expressly allows this despite this restriction (and then only to the extent the law allows).
  3. Circumvent licence checks or watermarks. Remove, disable, bypass, emulate or interfere with the licence checks, licence server communication, integrity checks, signatures or the watermarks and download marks in the Software and its packages, or run the Software against anything other than the 1onHost licence server.
  4. Modify the Software in a way that changes how licensing, add-ons or updates work, or remove any copyright, trademark or licence notice.
  5. Use it unlawfully. Use the Software to break the law or to harm others, or in breach of the 1onHost Terms of Service and Acceptable Use Policy.

Each package we deliver carries an invisible, signed mark that identifies the licence and download it was made for. If a package turns up outside the licensed server, we can trace it to the licence it was downloaded with.

3. Licence checks, updates and data

  1. The Software contacts the 1onHost licence server regularly to confirm the licence. It sends the server's public IP address, a hardware fingerprint, its hostname, the NovaPanel version and the identifier of the package it was installed from. We use this only to operate and protect the licensing system and to provide updates and malware signatures. Details are in our Privacy Policy.
  2. If the licence is not active (for example unpaid, suspended, revoked or moved to another server), the control panel locks and paid add-ons stop. Websites and e-mail hosted on the server keep running.
  3. Updates and malware signatures are available while the licence (and, for signatures, the Malware Scanner add-on) is active. We may change or stop features in new versions.

4. Termination and revocation

  1. Breach. This licence ends automatically, without notice, if you break section 2 or any other material term of this Agreement.
  2. Revocation. 1onHost may suspend or revoke a licence (through the licence server) if it is not paid, if we reasonably believe it is being misused, shared or used to run copies on unlicensed servers, or as allowed by the 1onHost Terms of Service.
  3. You may end this Agreement at any time by uninstalling the Software and cancelling your licence.
  4. After termination you must stop using the Software and delete all copies and packages you have. Sections 1.5, 2, 5, 6, 7 and 8 continue to apply. Termination for breach gives no right to a refund.

5. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT IT WILL BE ERROR-FREE OR UNINTERRUPTED. Security features, including the malware scanner and its signatures, reduce risk but cannot detect or stop every threat. You are responsible for your own backups, for the security of your servers, and for checking that the Software suits your needs. Some jurisdictions do not allow these exclusions; there, they apply to the fullest extent the law allows.

6. Limitation of liability

To the fullest extent the law allows:

  1. 1onHost is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, business or goodwill, arising from or related to the Software or this Agreement, even if we were told such damage was possible.
  2. 1onHost's total liability for all claims arising from or related to the Software or this Agreement is limited to the amount you paid 1onHost for the licence concerned in the twelve (12) months before the event that gave rise to the claim.
  3. Nothing in this Agreement limits liability that cannot be limited by law (for example for fraud, or for death or personal injury caused by negligence).

7. Third-party components

The Software includes open-source components under their own licences, listed in the NOTICE file shipped with the Software. Those licences apply to those components; nothing in this Agreement restricts rights they give you.

8. General

  1. Governing law and courts. This Agreement is governed by the laws of Pakistan, without regard to its conflict-of-law rules. The courts of Pakistan have exclusive jurisdiction, unless the law of your country of residence gives you a mandatory right to bring a claim there.
  2. Changes. We may update this Agreement for new versions of the Software. The version shown in the installer or the panel when you accept it applies; continued use of an update after we show you a new version means you accept that version.
  3. Entire agreement. This Agreement, together with the 1onHost Terms of Service, is the whole agreement about the Software. If they conflict about the Software, this Agreement wins.
  4. Severability. If a court finds part of this Agreement unenforceable, the rest stays in force and the part is enforced as far as the law allows.
  5. No waiver. Not enforcing a right at one time does not waive it.
  6. Export. You must comply with export control and sanctions laws that apply to the Software.
  7. Contact. Questions about this Agreement: through the 1onHost client area at https://1onhost.com.
